File a trademark application

Trademarks are registered by the Office of the Controller General of Patents, Designs and Trade Marks (IP India). Applications are filed online and, once registered, are valid for 10 years and renewable.

Steps

  1. 1

Search existing marks on the IP India public search to check availability

  2. 2

Create an account on IP India online filing and file Form TM-A, choosing the correct class(es) of goods/services

  3. 3

Pay the official fee online (lower for individuals, startups and small enterprises)

  4. 4

Respond to the examination report if objections are raised; attend a hearing if required

  5. 5

The mark is published in the Trade Marks Journal for opposition; if unopposed, it proceeds to registration

Documents

  • Logo/word mark
  • Applicant details
  • Statement of use (user affidavit) if claiming prior use
  • Power of attorney (if filed by agent)
  • Startup/MSME proof for reduced fee
